1. About VibeQuest Club

VibeQuest Club is operated by AchievMo Consulting LLC.

VibeQuest provides collectible merchandise, curated subscription experiences, gift products, Party Packages, sourcing services, collector features and related ecommerce and community services.

2. Acceptance of These Terms

By accessing the website, creating an account, submitting information, purchasing merchandise or using a VibeQuest service, you agree to these Terms and any additional policies or terms applicable to the specific service or purchase.

If you do not agree with these Terms, you should not use the affected VibeQuest service.

3. Eligibility & Account Responsibility

Purchases and customer accounts should be created and managed by individuals legally able to enter into the applicable transaction.

Customers are responsible for maintaining accurate account information and protecting account credentials from unauthorized use.

You are responsible for activity conducted through your account unless otherwise required by law.

4. Product Information

We make reasonable efforts to present accurate product descriptions, images, availability information and pricing.

Collectibles may contain normal manufacturer variation in packaging, paint, graphics, wheels, colors, cards, blisters or production details.

Product images may be representative and may not depict every variation of a product.

5. Pricing & Errors

Prices are shown in the currency identified on the website and may change without notice before an order is completed.

We reserve the right to correct typographical errors, pricing errors, product-description errors or other obvious mistakes.

If a material error affects an order that has already been submitted, VibeQuest may contact the customer with available options, including correction or cancellation where appropriate.

6. Orders

Submission of an order does not necessarily mean the order has been finally accepted or fulfilled.

Orders may be reviewed for inventory availability, payment authorization, fraud prevention, shipping restrictions or other legitimate business reasons.

VibeQuest may decline or cancel an order when reasonably necessary, including for inventory errors, payment problems, suspected fraud, legal restrictions or obvious pricing mistakes.

7. Payment

Customers authorize the applicable payment processor to charge the payment method selected during checkout for the amount displayed and agreed to at the time of purchase.

Payment processing may be performed by third-party providers subject to their own terms and privacy practices.

8. Taxes

Applicable sales tax or other transaction taxes may be calculated and collected as required based on the order, customer location and applicable law.

9. Shipping & Delivery

Shipping and fulfillment are governed by the applicable VibeQuest Shipping & Fulfillment Policy.

Customers are responsible for providing accurate and complete shipping information.

Delivery estimates are not guarantees unless a specific service is expressly identified as guaranteed.

10. Returns, Refunds & Order Problems

Returns, damaged merchandise, missing items, incorrect orders and refunds are governed by the VibeQuest Returns, Refunds & Order Issues Policy and any product-specific terms disclosed before purchase.

11. Subscription Services

Subscription products are also subject to the VibeQuest Subscription & Auto-Renewal Policy.

Recurring subscriptions renew according to the billing terms shown when the subscription is purchased unless cancelled according to the applicable cancellation process.

Customers remain responsible for reviewing the subscription price, billing frequency and renewal terms before completing checkout.

12. Subscription Cancellation

Cancelling a recurring subscription stops future renewals when cancellation is completed before the next applicable renewal charge.

Cancellation does not automatically cancel or refund an order that has already renewed, entered fulfillment or shipped.

13. Gift Boxes & Gift Subscriptions

Gift purchases are governed by the VibeQuest Gift Box & Gift Subscription Policy.

Unless expressly stated otherwise, prepaid Gift Subscriptions do not automatically renew after the purchased gift term ends.

14. Curated & Mystery Assortments

Certain VibeQuest products are intentionally curated or contain surprise assortments.

Customers purchasing these products generally do not select each individual item unless the applicable offer specifically provides item-selection options.

Curated and mystery products are also governed by the VibeQuest Mystery Box, Assortment & Chase Disclaimer.

15. Chase & Rare Products

Chase pieces, Treasure Hunts, Super Treasure Hunts, raw pieces, rare variants and other limited collectibles are not guaranteed unless a particular offer expressly says otherwise.

16. Collector Preferences

When VibeQuest allows customers to provide collector preferences, those preferences may be used to guide curation, recommendations or sourcing.

Preferences do not guarantee a particular product, brand, casting, color or assortment.

17. Duplicate Protection

When duplicate protection is offered as a subscription or membership benefit, the applicable program description governs its scope.

Duplicate protection generally applies to the same product or SKU and does not necessarily prevent related models, alternate colors, liveries, variants or different releases from appearing.

18. VibeQuest Scout

VibeQuest Scout is a sourcing and discovery service designed to help collectors locate desired items.

Scout activity is subject to the separate VibeQuest Scout Program Terms & Sourcing Policy.

Submitting a Scout request does not itself create an order, guaranteed price, reservation or promise that the requested item will be located.

19. Party Packages

Party Package purchases are governed by the VibeQuest Party Package Policy.

Unless expressly included in the offer, purchasing a Party Package does not include event hosting, childcare, supervision, entertainment or on-site staffing.

20. Pre-Orders

Pre-orders may be subject to estimated manufacturer or distributor release schedules.

Release dates may change, and availability may be affected by allocation, production changes, licensing changes, shipping conditions or supplier decisions outside VibeQuest's control.

Product-specific pre-order terms disclosed at the time of purchase also apply.

21. Promotions, Discounts & Rewards

Promotional codes, discounts, loyalty rewards, credits, contests, giveaways and special offers may be subject to additional eligibility rules and expiration dates.

Unless expressly stated otherwise, offers may not be combinable and have no cash value.

22. Resale & Market Value

Collectibles may increase or decrease in secondary-market value.

VibeQuest does not guarantee future resale price, appreciation, investment performance or secondary-market demand for any collectible.

Market information, estimated values or pricing discussions are informational and are not professional investment or appraisal services.

23. Product Authenticity

VibeQuest does not knowingly sell counterfeit merchandise as authentic branded merchandise.

Unless a product is expressly sold with a separate written authentication guarantee, VibeQuest is not acting as a professional authentication or certification service.

24. Intellectual Property

VibeQuest branding, original website content and original creative materials are owned by AchievMo Consulting LLC or used under applicable rights.

Third-party trademarks, product names, vehicle names, logos and other intellectual property remain the property of their respective owners.

25. No Implied Third-Party Endorsement

The sale, discussion or display of products associated with a third-party brand does not imply that VibeQuest is sponsored, endorsed or officially affiliated with that brand unless expressly stated.

26. Customer Content

Customers should only submit reviews, images, comments, artwork or other content that they have the right to provide.

Content submitted for public-facing reviews, contests, promotions or community features may be used in connection with those features subject to applicable law and any additional terms presented at submission.

27. Acceptable Use

Customers may not misuse the website or VibeQuest services.

Prohibited conduct includes attempting to:

• Commit fraud or impersonate another person.
• Submit false payment or account information.
• Interfere with website security or operation.
• Use automated systems to abuse inventory, promotions or checkout.
• Upload malicious code.
• Misuse customer-support systems.
• Engage in unlawful activity through VibeQuest services.

28. Fraud & Abuse

VibeQuest may cancel orders, restrict accounts, limit promotions or take other reasonable action when fraud, abuse, chargeback manipulation, product substitution, repeated bad-faith claims or other harmful activity is reasonably suspected.

29. Customer Communications

Transactional, support, subscription and promotional communications are governed by the VibeQuest Customer Support & Communications Policy and Privacy Policy.

Customers are responsible for maintaining accurate contact information.

30. Privacy

Personal information is handled according to the VibeQuest Privacy Policy and applicable law.

Use of cookies and similar technologies is further described in the VibeQuest Cookie Policy.

31. Accessibility

VibeQuest is committed to ongoing accessibility improvements.

32. Third-Party Services

VibeQuest may use or link to third-party services for payment processing, shipping, analytics, social media, ecommerce functionality or other services.

Third-party services may be governed by their own terms and privacy policies.

33. Website Availability

We aim to maintain reliable website and account access, but uninterrupted operation cannot be guaranteed.

Maintenance, hosting issues, software updates, third-party outages or other technical events may temporarily affect availability.

34. Disclaimer of Warranties

To the extent permitted by law, VibeQuest services and website functionality are provided on an "as available" basis.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

35. Limitation of Liability

To the maximum extent permitted by applicable law, AchievMo Consulting LLC will not be liable for indirect, incidental, special, consequential or punitive damages arising solely from use of the website or VibeQuest services.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

36. Indemnification

To the extent permitted by law, users agree to be responsible for losses or claims arising from their unlawful misuse of VibeQuest services, violation of these Terms or infringement of third-party rights.

37. Governing Law

These Terms are governed by the laws applicable to AchievMo Consulting LLC's operations in the State of Florida, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

38. Disputes

Before pursuing formal action, customers are encouraged to contact the VibeQuest Support Center so that concerns can be reviewed and a reasonable resolution attempted.

Nothing in this section eliminates legal rights or remedies that cannot lawfully be waived.

39. Severability

If a provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

40. No Waiver

Failure to enforce a provision of these Terms on one occasion does not automatically waive the right to enforce that provision later.

41. Policy Relationship

These Terms should be read together with applicable VibeQuest policies and product-specific terms.

If a specific offer contains additional terms, those terms apply to that offer. Where terms conflict, the more specific applicable terms generally control for that transaction, subject to applicable law.

42. Changes to These Terms

We may update these Terms as VibeQuest products, services, technology or legal obligations change.

The current version will be posted on this page with the latest update date.
